GENERAL POINTS
Any order means the agreement) of the buyer in the conditions of sale below which are considered perfectly known and accepted. As a consequence, no other special condition can pride the application of the current conditions. These terms of sale are valid for the completeness of products available on this site
PRICES
The prices communicated in our price-list are always given taxes included and, except particular conditions get postage paid. Postal charges will be calculated between both parts according to the désidératas of the customer.
PAYMENT
The payment in full is always asked except preliminary agreement between both parts(parties).
DELAY OF DELIVERY
Our delivery periods are always given as a rough guide. Whatever is the delay agreed for the delivery, no allowance can be asked in case of delay, unless opposite condition asked by us. In any hypothesis, we are loosened(kicked away) by rights of our commitments relative to the delivery periods in case of events of forçe adult including any grêve, lockout, delay in transport and any cause emanating from an unemployment, even a mid term one, in he factories of our suppliers.
It's the same in the case or our debts would not have been honored in the agreed terms. The delays cannot justify the cancellation, even partial, the order
SHIPMENTS
The shipment is done by the shipper we choose. The transfer of the risks takes place at the time of the shipping. In case of lack or of average, the addressee has to make at once reserves written with the carrier in the arrival of the goods without ommettre to confirm them to him(her) by registered letter A.R within 48 hours after the reception of the goods (article 105 of the commercial law)
INVOICING
Unless otherwise stipulated from our part, our products are charged according to the prices of our price lists current in the delivery date.
PROPERTY RESERVES
According to the law n°80-335 of May 10th, 1980, completed by the law of modified 25/01/1985, the transfer of the property of the product to the buyer will be postponed up to the complete payment of the price. For lack of payment of a simple fraction of the price with term, the salesman can take back the product without the other formality and about is the owner.
RETURN OF MATERIAL
The customer has a delay of 8 days as from the date of reception of the goods to return them possibly. Any return must be accompanied with a check, a rappellant our own delivery order and if necessary our invoice made carriage paid. The goods must be packed in their original package The non compliance with these conditions will engender from our part, the refusal of return.
WARRANTY
Our guarantee is limited to the replacement or in the repair in our studios and by our care of the defective recognized réféence. On no account, the guarantee implies the possibility of a demand of compensation or damages for any cause
COURT OF LAW
Any protest or dispute shall be governed by the trade court of Marseille.
